Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Flowtag ("Platform"), a cloud services platform operated by Flowtag Software, based in Poland ("we", "us", or "our").

By creating an account or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms apply to all users, including individuals, teams, and organizations on any subscription plan.

2. The Platform and Services

Flowtag is a cloud platform providing developer-focused services. Currently available and planned services include:

Each service may be subject to additional service-specific terms or documentation. In the event of a conflict between these Terms and service-specific terms, the service-specific terms apply to the extent of the conflict.

We may introduce new services, modify existing ones, or discontinue services over time. Where a service is discontinued, we will provide reasonable notice.

3. Eligibility

  • You must be at least 16 years old to use the Platform.
  • If you are using the Platform on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
  • You must not be located in a country subject to a trade embargo or sanctions that would prohibit use of the Platform.

4. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for keeping your login credentials secure. Do not share your password with anyone.
  • You are responsible for all activity that takes place under your account, whether or not authorized by you.
  • If you suspect unauthorized access to your account, notify us immediately at hello-flowtag@qwerty.ovh.
  • We reserve the right to refuse registration or suspend accounts at our discretion.

5. Plans, Billing and Payments

5.1 Subscription Plans

Flowtag offers multiple subscription tiers (Starter, Pro, Enterprise) with different usage limits and access to services. Details are available on the pricing page.

5.2 Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. By purchasing a subscription, you agree to Paddle's Terms of Service and Paddle's Privacy Policy.

Flowtag does not store your card numbers or full billing details.

5.3 Billing Cycle

Subscriptions are billed monthly and renew automatically at the end of each billing period. You will be charged at the start of each new billing cycle.

5.4 Pricing

Prices are as displayed on the pricing page at the time of purchase. For Enterprise and SLA add-on plans, the quoted price is indicative — the final price is agreed upon in a separate contract or order form.

We reserve the right to change pricing at any time. For existing subscribers, price changes take effect at the next renewal, with at least 30 days' notice.

5.5 Taxes

Prices may be subject to applicable taxes (e.g. VAT). Paddle is responsible for calculating and remitting applicable taxes as Merchant of Record.

5.6 Refunds

Our refund policy is governed by the separate Refund Policy.

6. Free Plan

The Starter plan is provided free of charge, subject to usage limits defined in the plan description. We reserve the right to:

  • Modify or discontinue free plan benefits with reasonable notice.
  • Suspend or terminate free accounts that are inactive for more than 6 consecutive months.

7. Acceptable Use

You may use the Platform only for lawful purposes and in accordance with these Terms. You may not:

  • Bypass or circumvent usage limits (e.g., creating multiple free accounts or organizations to avoid plan restrictions).
  • Perform or facilitate DDoS attacks, hacking, or any attempt to disrupt or damage the Platform or its infrastructure.
  • Transmit fake, synthetic, or poisoned data to manipulate results — including analytics events, configuration values, or stored secrets.
  • Use bots or automated tools to abuse Platform resources or artificially inflate usage metrics.
  • Use the Platform in a way that violates any applicable law or regulation.
  • Reverse-engineer, decompile, or attempt to extract source code from the Platform.
  • Resell or sublicense access to the Platform without prior written authorization.
  • Attempt to gain unauthorized access to other users' accounts, data, secrets, or configurations.
  • Use the Platform to store or transmit malware, exploits, or any malicious code.

Violation of these rules may result in immediate account suspension or termination without refund.

8. Service-Specific Terms

8.1 Analytics

You are solely responsible for how you implement and configure Flowtag Analytics trackers on your websites or applications. This includes:

  • Obtaining legally required consent from your end users before enabling tracking (e.g. cookie consent banners under GDPR, ePrivacy Directive, CCPA).
  • Disclosing your use of analytics in your own privacy policy.
  • Ensuring that data collected via Flowtag from your users complies with applicable privacy laws in your jurisdiction.

Flowtag is not responsible for any regulatory penalties, fines, or legal claims arising from your failure to comply with applicable privacy or data protection laws.

8.2 Variables (Edge Config)

Variables allows you to store and distribute configuration data at the edge. You are responsible for the content and accuracy of any configuration values you store. You must not store sensitive credentials or secrets in Variables — use Vault for that purpose.

8.3 Vault (Secret Storage)

Vault stores encrypted secrets, tokens, and keys on your behalf. You acknowledge that:

  • You are responsible for managing access to your secrets and rotating them when necessary.
  • Flowtag encrypts secrets at rest, but you bear responsibility for controlling who in your organization has access.
  • In the event of accidental exposure of a secret, you should revoke and rotate it immediately. Flowtag is not liable for damages resulting from secrets that were exposed due to misconfiguration on your part.
  • You must not store secrets that violate applicable law or that you are not authorized to possess.

9. Data and Privacy

Your use of the Platform is subject to our Privacy Policy, which explains what data we collect, how we use it, and your rights. Data processing is also covered by our Data Processing Agreement (DPA) for customers who require it.

Data retention periods for your analytics data depend on your subscription plan. See the Analytics & Data Retention Policy for details.

10. Service Availability

10.1 Standard Service

The Platform is provided "as is" and "as available". We do not guarantee any specific level of uptime unless you have an active SLA package.

We are not liable for:

  • Downtime, outages, or service interruptions.
  • Data loss resulting from server failures, bugs, or infrastructure issues.
  • Temporary suspension of the Platform for maintenance purposes.

10.2 SLA Packages

Customers who have purchased an SLA add-on receive specific uptime guarantees and support commitments defined in the SLA Agreement. In the event of a conflict between these Terms and the SLA, the SLA applies to the extent of the conflict.

11. Data Loss

Data corruption, deletion, or permanent loss may occur across any service. Except where expressly covered by an active SLA package, Flowtag has no obligation to recover or restore lost data, configurations, or secrets.

We strongly recommend:

  • Maintaining backups of critical analytics data where possible.
  • Keeping local copies of secrets stored in Vault.
  • Versioning your edge configuration values externally when operating in critical environments.

12. Intellectual Property

12.1 Our IP

All elements of the Platform — including software, design, logos, trademarks, and documentation — are the property of Flowtag Software or its licensors. Nothing in these Terms grants you ownership or a license to use our intellectual property beyond what is necessary to use the Platform as intended.

Flowtag's trademark usage is governed by our Trademark Policy.

12.2 Your Data

You retain ownership of all data you store or collect through the Platform — including analytics events, configuration values, and secrets. By using the Platform, you grant us a limited license to process and store your data solely for the purpose of providing the services.

13. Confidentiality

We will keep your account data and service data confidential and will not share it with third parties except:

  • As required by law or valid legal process.
  • With sub-processors necessary to operate the Platform (see our Sub-processors list).
  • With your explicit consent.

14. Termination

14.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. See the Refund Policy for refund eligibility.

You may delete your account at any time. Upon deletion, your data will be removed according to the retention periods described in the Privacy Policy.

14.2 By Us

We may suspend or terminate your account without prior notice if:

  • You violate these Terms (particularly Section 7 — Acceptable Use).
  • Your account is used in a fraudulent or abusive manner.
  • We are required to do so by law or court order.

Upon termination for cause, no refund will be issued for the remaining subscription period. However, we may issue a refund at our sole discretion in exceptional circumstances — for example, where a purchase was made by a user who did not meet the eligibility requirements at the time of purchase (see Section 3). Such refunds are evaluated case by case and do not constitute a general entitlement.

14.3 Effect of Termination

Upon termination, your access to the Platform ceases. Data may be retained for a limited period as described in the Privacy Policy before permanent deletion.

Where termination is not related to unlawful data collection or data misuse, you retain the right to request an export of your data before deletion — regardless of the reason for termination. For example, if an account is terminated due to an eligibility violation (e.g. age), the user may still request export of legally collected data, as this right is independent of account standing and is protected under applicable data protection law (including the GDPR right to data portability, Art. 20).

To request a data export after termination, contact us at hello-flowtag@qwerty.ovh. While in-app data export is a paid feature, post-termination export requests are handled manually regardless of your plan, as this right is not contingent on subscription status. We will fulfill the request within 30 days where technically feasible.

Where termination is caused by data-related violations (e.g. collection of unlawful data, poisoning of other users' data), we reserve the right to withhold or restrict export at our discretion.

15. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Flowtag's total liability for any claim arising from or related to these Terms or the Platform shall not exceed the amount you paid for the Platform in the 3 months immediately preceding the claim.
  • Flowtag is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, secrets, goodwill, or business opportunities.
  • The Platform is used at your own risk.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

16. Indemnification

You agree to indemnify and hold harmless Flowtag Software, its directors, employees, and contractors from any claims, damages, or expenses (including legal fees) arising from:

  • Your use or misuse of the Platform or any of its services.
  • Your violation of these Terms.
  • Your violation of any third-party rights or applicable laws, including privacy and data protection laws.
  • Exposure or misuse of secrets stored in Vault due to misconfiguration or unauthorized access on your end.

17. Governing Law and Disputes

These Terms are governed by the laws of Poland, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Poland.

If you are a consumer based in the European Union, you may also be entitled to bring a claim before the courts in your country of residence, or seek assistance through your national consumer protection authority or alternative dispute resolution body via the EU Consumer Redress platform.

18. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify you by:

  • Email to the address associated with your account, and/or
  • In-app notification.

Changes take effect 14 days after notification unless you object before the effective date by contacting us. Continued use of the Platform after that date constitutes acceptance of the revised Terms.

19. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, Refund Policy, DPA, and any applicable SLA or service-specific terms, constitute the entire agreement between you and Flowtag regarding the Platform.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.
  • Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights to a successor entity in the event of a merger, acquisition, or sale of assets.
